Please read these Terms and Conditions carefully before using our website or purchasing any products. By accessing or using The Guided Studio's website, tools, or digital products, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. About The Guided Studio

The Guided Studio is a digital product brand offering specialized tools, workbooks, clinical guides, and interactive resources designed exclusively for licensed mental health professionals. Our offerings are focused on EMDR therapy, trauma treatment, expressive arts therapy, and parts work, and are intended to support clinicians in their professional practice — not for use by the general public.

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and The Guided Studio ("we," "us," or "our") and govern your use of our website, digital products, downloadable materials, interactive tools, and any related services (collectively, the "Services").

2. Eligibility and Professional Use Requirement

2.1 Who May Use Our Services

Our Services are intended solely for licensed or credentialed mental health professionals, including but not limited to licensed professional counselors, licensed clinical social workers, licensed marriage and family therapists, psychologists, psychiatrists, and supervised trainees under the direct oversight of a licensed supervisor. By accessing our Services, you represent and warrant that you hold the appropriate professional credentials required to use clinical tools in your jurisdiction.

Our products are not designed for, marketed to, or appropriate for use by the general public, individuals seeking personal self-help resources, or unlicensed individuals acting outside the scope of a supervised clinical role.

2.2 Minimum Age

You must be at least 18 years of age to use our Services or make a purchase.

2.3 Account Responsibility

If you create an account with The Guided Studio, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

 

3. Clinical Disclaimer and Limitation of Scope

3.1 Not Clinical Advice

The resources, tools, workbooks, and information provided by The Guided Studio are intended for educational and professional support purposes only. Nothing within our Services constitutes medical advice, psychiatric evaluation, clinical diagnosis, or a recommendation for any specific therapeutic intervention with any individual client.

3.2 Your Professional Responsibility

As a licensed clinician, you bear sole professional and ethical responsibility for determining the appropriateness of any tool, resource, or technique for a given client. You must apply your own clinical judgment, adhere to your professional licensing board's standards of care, and comply with all applicable ethical codes and regulations. The Guided Studio does not supervise, direct, or oversee your clinical practice.

3.3 Mandatory Per-Visit Disclaimer Agreement

Access to certain interactive tools and public-facing applications provided by The Guided Studio requires your explicit agreement to our clinical disclaimer upon every visit, regardless of prior acknowledgment. This is a non-negotiable requirement and exists to ensure ongoing, active acknowledgment of the professional nature and limitations of our tools. Declining the disclaimer will prevent access to the relevant tool or application.

4. Intellectual Property and Licensing

4.1 Ownership

All content available through The Guided Studio — including but not limited to digital workbooks, worksheets, clinical guides, interactive tools, graphic designs, written text, audio materials, and website content — is the exclusive intellectual property of The Guided Studio and is protected by applicable copyright, trademark, and intellectual property laws. Purchasing a product does not transfer ownership of any intellectual property to you.

4.2 License Grant

Upon completing a purchase, The Guided Studio grants you a limited, personal, non-exclusive, non-transferable, and revocable license to use the purchased materials in accordance with these Terms. This license is granted solely to you as the individual purchaser and does not extend to other clinicians, colleagues, or organizations unless a separate multi-user or institutional license has been explicitly purchased.

4.3 Permitted Uses

Under this license, you are authorized to:

 

Print for clients

Download and print copies to use directly with your individual clients, couples, or groups with whom you have an established professional relationship

Share with clients

Transmit digital copies of client-facing worksheets to your own clients via secure, private channels such as a HIPAA-compliant email or client portal

Use in telehealth sessions

Display materials on-screen during video-based therapy sessions

Use in your own practice

Reference and apply the clinical frameworks and tools within your direct professional work

4.4 Prohibited Uses

The following uses are strictly prohibited and constitute a violation of these Terms and applicable intellectual property law:

•Reselling or redistributing any product, worksheet, or material, whether for profit or free of charge, to any individual who has not purchased their own license.

•Sharing with colleagues or supervisees who have not independently purchased the product. Each clinician must hold their own license.

•Uploading to shared platforms, including but not limited to public websites, shared cloud drives, group platforms, or any location accessible to non-purchasers.

•Modifying, adapting, or creating derivative works from our materials, including rebranding, translating, or reformatting for redistribution.

•Removing or obscuring The Guided Studio's copyright notices, branding, or watermarks from any material.

•Reproducing our materials in online courses, trainings, webinars, or continuing education offerings, whether paid or free.

•Using our materials to train, develop, or fine-tune any artificial intelligence model, large language model, or automated system.

•Sharing account access with any other individual.

 

5. Purchases, Payments, and Refund Policy

5.1 Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. We reserve the right to modify pricing at any time. Payment is processed securely through our third-party payment processor(s). By completing a purchase, you authorize us to charge your selected payment method for the total amount due.

 

5.2 Digital Products — All Sales Final

Because our products are delivered digitally and are immediately accessible upon purchase, all sales are final. We do not offer refunds, returns, or exchanges once a digital product has been purchased and the file or access link has been delivered, regardless of whether the file has been downloaded or opened.

We strongly encourage you to review all product descriptions, previews, and any available sample content before completing your purchase. If you have questions about a product prior to purchasing, please contact us.

 

5.3 Subscription and Tool Access

Certain interactive tools or premium content areas may require a mandatory subscription or account registration for access. Subscription fees, billing cycles, and cancellation terms will be clearly disclosed at the point of sign-up. Cancellation of a subscription will not result in a refund for any previously billed period.

 

5.4 Exceptions

In the rare event that a product is delivered incorrectly, is technically inaccessible due to an error on our end, or is materially different from its description, please contact us within 7 days of purchase and we will work to resolve the issue, which may include a replacement, store credit, or, at our sole discretion, a refund.

 

6. Privacy, Data Transparency, and AI Disclosure

6.1 Privacy Policy

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, store, and protect your personal information.

 

6.2 Transparency in Interactive Tools

The Guided Studio is committed to full transparency regarding data collection and the use of artificial intelligence within our tools. For each interactive or public-facing tool we offer:

•Static tools that do not collect user data or engage active AI processing will clearly state this within the tool's interface.

•Tools that collect data or use AI features will disclose this clearly before you access or use the tool, and will describe what data is collected, how it is used, and how it is protected.

We prioritize building tools that allow you to maintain control over your data and your clients' data, and we avoid unnecessary reliance on third-party platforms wherever possible.

 

6.3 Client Data

You are solely responsible for ensuring that your use of our tools complies with all applicable privacy laws and regulations, including HIPAA (if applicable in your jurisdiction), and with your professional ethical obligations regarding client confidentiality. Do not enter any identifiable client information into any tool or platform unless you have verified that it meets your jurisdiction's data security requirements.

 

7. Inclusive Language and Community Standards

7.1 Our Commitment to Inclusive Language

The Guided Studio is deeply committed to trauma-informed, neurodivergent-affirming, and culturally responsive practice. Our content is developed with intentional care around language. We use terminology such as "parts work" or "IFS-informed" and prefer "aspects" or "parts" when referring to internal experiences. We avoid terms that carry harmful historical connotations or that may cause harm to individuals with dissociative experiences.

 

7.2 User-Generated Content

If any area of our platform permits user-generated content (such as community forums or comments), you agree to uphold these same standards of inclusive, respectful, and professional communication. Content that is discriminatory, harmful, or violates professional ethical standards may be removed at our discretion.

8. Third-Party Links and Resources

Our website may contain links to third-party websites, resources, or tools. These links are provided for informational purposes only. The Guided Studio does not endorse, control, or assume responsibility for the content, privacy practices, or accuracy of any third-party site. Your use of any third-party site is at your own risk and subject to that site's own terms and conditions.

 

9. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The Guided Studio does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

 

10. Limitation of Liability

10.1 Liability Cap

To the fullest extent permitted by applicable law, The Guided Studio, its founders, team members, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, goodwill, or clinical outcomes — arising out of or related to your use of or inability to use the Services.

 

In no event shall The Guided Studio's total liability to you for all claims arising out of or related to these Terms or the Services exceed the total amount paid by you to The Guided Studio in the twelve (12) months preceding the claim.

 

10.2 Clinical Liability

The Guided Studio expressly disclaims any liability for clinical outcomes, client responses, therapeutic decisions, or professional consequences arising from your use of our products in a clinical setting. You assume full professional responsibility for all clinical applications of our materials.

11. Indemnification

You agree to defend, indemnify, and hold harmless The Guided Studio and its affiliates, founders, employees, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Services in a manner not authorized by these Terms; (c) your clinical application of our products; or (d) your violation of any applicable law or third-party rights.

12. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, notify you via email or a prominent notice on our website. Your continued use of the Services after any changes take effect constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

 

13. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to The Guided Studio, other users, or third parties. Upon termination, your license to use any purchased materials is revoked, and you must cease all use of our products.

 

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which The Guided Studio is registered, without regard to conflict of law principles. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. 15. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and The Guided Studio with respect to the Services and supersede all prior agreements.
